Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers’ Grade than their juniors -regarding.
 
Ref: OM No.18/2/2007-CS-l dated 20.05.2014 & 08.07.2014 and OM No.18/212014-CS.l(S) dated 27.12.20216.
 
Representations have been received from some CSS officers in whose case re-fixation and recovery orders have been issued by concerned Ministries/Departments in pursuance to DOPT OM dated 20.05.2014, requesting withdrawal of the OMs referred above.
 
2. It is once again clarified that OM No.5/16/80-CS.I dated 13.4.1988 was issued on acceptance of award by Board of Arbitration in CA Reference No.7 of 1984 which allowed stepping up of pay of an Assistant of CSS, who is senior by virtue of having been recruited through an earlier examination but is drawing less pay on promotion in the Grade of Section Officer than his junior recruited through a later examination, up to a level equal to the pay of such junior Section Officer in the same cadre i.e. senior DR Assistant to junior DR Assistant of later exam on their promotion as Section Officer. Vide OM No.5/21/92-CS.I dated 23.2.1994 this benefit of stepping up was extended to Section Officers appointed through Limited Departmental Competitive Examination (LDCE) (again applicable to DR Assistants only). OM No.5/1/96-CS.I dated 8.10.1996 further extended this benefit in case of promotee Assistants and also to the cases where both junior and senior have been recruited on the basis of the same Select List Assistants Grade Examination, as the case may be in accordance with judgements of CAT in OA No. 365/90 (Shri K.C. Sehgal VS UOI and CA No. 869/91 (Shri L.K. Chawla VS UOI), which were upheld by the Hon’ble Supreme Court.
 
3. That there are general guidelines of stepping up of pay issued by the Ministry of Finance vide OM No.F.2(78)-E.III(A) dated 0 .02.1966 and this Department vide OM dated 04.11.1993. One of the conditions of the general guidelines for allowing stepping up of pay to a senior govt. servant with reference to a junior is that the senior should have drawn more pay than the junior in the lower grade also.
 
4. However, certain clarifications were issued by CS-I Division, DoPT in 2007 and 2008 to individual Ministries/Departments, on references received from them, which were at variance with the general conditions of stepping up of pay i.e. stepping up of pay was allowed even if junior was drawing more pay than the senior in the lower grade i.e. in Assistant/Grade. Therefore, vide OM dated 29.5.2009, the clarification issued in 2007 & 2008 were withdrawn and Ministries/Departments were advised to strictly allow stepping up enforcing conditions laid down in OM dated 8.10.1996. Departments were also informed vide OM dated 21.05.2010 that as the matter was still under consideration, status-quo, as on date, might be maintained in the matter of stepping up of pay of Section Officers of CSS till the matter attains finality. Eventually, the matter attained finality and a consolidated OM as vetted by the Estt..(Pay) Division of this Department and Department of Expenditure was issued on 20.05.2014.
 
5. The Ministries/Departments were requested vide OM dated 20.05.14 that stepping up of pay already allowed in cases where the individuals are not covered by the OMs dated 13.04.1988, 23.02.1994 and 08.10.1996 and general conditions as laid down in OM dated 04.11.193, should be reviewed and pay re-fixed accordingly. That excess payments made to the employees in the cases of wrong stepping up of pay should be recovered in terms of DOP&T’s OM No.18/26/2011-Estt(Pay-l) dated 06.02.2014 and a compliance report in this regard furnished to this Department. It was further clarified vide OM dated 08.7.2014 that all the three OMs and general conditions of stepping up of pay are not exclusive of each other and the three OMs are to be read with and subject to the general conditions reiterated vide OM dated 4.11.1993, therefore, stepping up of pay is not to be allowed where junior was drawing more pay than the senior in the lower grade.
 
6. As regards, OA No.2884/2015 and similar OAs filed in this regard, it is observed that only applicants in these cases have been granted interim stay by the Learned CAT. That the said OAs have been filed by the applicants in the individual capacity. Thus in all those cases where stepping up of pay has been allowed, but where the benefited individuals were not covered by the OMs dated 13.4.88, 23.2.94 and 8.10.96 and the general conditions of stepping up of pay as laid down in the DOP&T’s OM No. 4/7/92-Estt(Pay-1) dated 04.11.93, pay will have to be re-fixed and recovery of excess payment, if any, is to be made.
 
7. Therefore, vide reminder OM dated 27.12.16, the Ministries/Departments were requested to expedite the compliance reports as requested vide OM dated 20.05.2014 except in those cases where matter of recovery is subjudice/stayed by order of any competent court.
 
8. It may be mentioned that one of the similarly placed officers, in whose case orders for stepping up of pay with reference to a promotee assistant was issued but not implemented, had approached CA (PB) through OA No.1199/2014(H.C. Rai vs. UOI). The CAT vide its order dated 28.03.17 while dismissing the OA had categorically ruled that the stepping up of his pay was not in consonance with the provisions of OM dated 20.05.2014 i.e. OMs dated 13.4.88, 23.2.94 and 8.10.96.
 
9. With regards difficulty being faced by some Ministries/Departments in establishing links/chain of officers in refixation/recovery matters, it is hereby mentioned that many Ministries/Departments have already issued re-fixation orders establishing links by themselves as per the instructions issued by this Department.
 
10. All the Ministries/Departments are thus again requested to furnish the compliance reports in the prescribed proforma, latest by 15th November 2017.

Sub: Simplification of procedure for treatment at private hospitals empanelled under CGHS/CS (MA) Rules, 1944
With reference to the above mentioned subject the undersigned is directed to state that this Ministry has been receiving representations for simplification of procedure for undergoing treatment at private hospitals empanelled under CGHS. The matter has been examined and it has now been decided that CGHS beneficiaries are allowed to undergo treatment at private hospitals empanelled under CGHS of specific treatment procedures listed under CGHS rate list are advised by a Specialist in a Central Government / State Govt. Specialist hospital or a CGHS Medical Officer without any requirement of any other referral (permission) letter.
 
2. Private empanelled hospitals shall perform the treatment on cashless basis in respect of pensioners, ex-MPs, Freedom Fighters, Regular employees {both CGHS and CS (MA) beneficiaries} of this Ministry & other categories of CGHS beneficiaries, who are presently eligible for credit facility and shall enclose the prescription issued by Government Specialist or a CGHS Medical Officer, in original (or a self-attested photocopy) along with the hospital bill submitted to the competent authorities.
 
3. Serving government employees shall enclose the prescription issued by a Government Specialist or a CGHS Medical Officer in original (or a self-attested photocopy), while submitting the medical claim to the concerned Ministry /department/office for reimbursement.
 
4. CGHS Medical Officer / Government Specialist shall not refer the beneficiaries to any particular empanelled hospital by name but, shall specify the treatment procedure and mention ‘referred to any CGHS empanelled centre’.
 
5.These orders are applicable only in respect of treatment procedures for which CGHS rates are available.

कांग्रेस के राज्यसभा सदस्य मोतीलाल वोरा ने रेलवे मंत्रालय से एक मासूम सा सवाल पूछा. सवाल यह था कि रेलवे ने पिछले तीन साल में कितने नए कर्मचारियों को नौकरी पर रखा और इस दौरान कितने कर्मचारी रिटायर हो गए.

सरकार ने 11 अगस्त, 2017 को राज्यसभा में जानकारी दी कि पिछले तीन साल में रेलवे में 1,15,003 कर्मचारियों और अफसरों को नौकरी पर रखा और इसी दौरान 1,79,322 कर्मचारी और अफसर रिटायर हो गए.

“At a meeting of the DGP, it was unanimously decided by officers to change the colour of khaki trousers to blue from December 1. It has been done to give the traffic police a separate identify,” a senior official said here.

Sub: Guidelines on Air Travel on Government Expenses – Purchase of Tickets from Authorised Agent- reg.

The undersigned is directed to refer to Got 14 below SR 48-B wherein provision has been made that in all cases of air travel, where Govt. of India bears the cost of air passage, the officials have to travel, only by Air India. Further, GoI 16 below the rule stipulates for purchase of air ticket directly from Airlines (Booking Counter or website of Airlines) or by utilizing the services of the authorised agents viz. M/s. Balmer Lawrie & Co., M/s Ashoka Travels & Tours and IRCTC. Department of Expenditure, M/o. Finance time and again also stressed the need of travel only by Air India and purchase of air tickets from permissible source. Recent in this row is their OM No. 19024/22/2017 E-IV dated 18th July, 2017 (copy enclosed for ready reference).

2. Despite this MHA is frequently in receipt of proposals for relaxation of above rules citing reason of ignorance/unawareness of these guidelines. Department of Expenditure has clarified to MHA that henceforth relaxation on account of ignorance/unawareness of the guidelines would not be considered by them in future.

3. It is, accordingly, stressed upon all the offices/Division under the ambit of Integrated Finance Division of MHA to scrupulously follow the guidelines relating to air travel.

“CHILDREN EDUCATION ALLOWANCE:
As specified in the Govt. letter No. 1(23) / 2017 / D(Pay/ Services) dated 15/09/2017, reimbursement of CEA is to be claimed once in a year, after completion of the Financial Year based on certificate from the Head of the Institution, where the ward of the employee is studying
HOSTEL SUBSIDY:
Similar procedure is to be applied for Hostel Subsidy. The certification from the Head of Institute should also mention the amount of expenditure incurred by the Govt servant towards boarding and lodging.
These orders are applicable from 01/07/2017.
Claims on account of CEA & Hostel Subsidy w.e.f. 01/07/2017 may be forwarded after completion of the financial year.
Claims already submitted for the period 01/07/2017 onwards are being returned unsanctioned.
TRAVELLING ALLOWANCE ENTITLEMENTS:
GoI, MoD letter No. 12630/TA/DA/Mov C dated 15th September 2017 regarding provisions relating Travelling Allowance Entitlements, are effective from 01/07/2017.
Service Personnel, who had undertaken tours and had been transferred between 01 / 07 / 2017 and the date of issue of these orders i.e. 15th Sep 2017 and whose TA/ DA claims have been settled with reference to their earlier entitlements as per 6th CPC, may submit supplementary claims based on their revised entitlement as per 7th CPC.”

A lot number of news reports have been claiming that the minimum pay may be hiked under 7th Pay Commission for Central government employees. Some news reports even claimed that the minimum pay will be hiked to Rs 21,000 from Rs 18,000. But, the million dollar question – When will it happen? Reportedly, Narendra Modi government wants this to happen by January 2018, as per OneIndia. Earlier, it was reported that Narendra Modi government has finally given a green signal for the hike in minimum pay and fitment factor of the Central government employees. This was a big news for Central government employees. After this, National Anomaly Committee (NAC) and Department of Expenditure will take a final call on the matter. NAC has got the nod from the government to increase minimum salary and fitment factor, according to a report in Jansatta. Now, it is being expected that the minimum salary will go up to Rs 21,000 from Rs 18,000.

NAC was formed to look into various pay related anomalies arising out of the implementation of the Seventh Central Pay Commission’s recommendations. The 22-member panel is being headed by Secretary, Department of Personnel and Training (DoPT) and has members of both the official and staff side.
 
“It has been decided to set up the anomaly committee of the National Council (Joint Consultative Machinery) consisting of representatives of the official side and the staff side to settle any anomalies arising out of the implementation of the Pay Commission’s recommendations,” an order issued by the DoPT had said.
 
On June 28, in a bonanza to 48 lakh central government employees, the Union Cabinet had approved recommendations of 7th Central Pay Commission with 34 modifications. The increased allowances came into effect from July 1, 2017, is based on the recommendations of the Committee on Allowances (CoA).

Subject: Grant of Fixed Medical Allowance (FMA) to the Armed Forces Pensioners / Family Pensioners in such cases where date of retirement is prior to 01.04.2003 and who had opted not to avail medical facilities at OPD of Armed Forces Hospitals/ MI Rooms and are not members of ECHS.
Reference: 1). This office Circular No. 544 dated 04.06.2015, Circular No. 451 dated 21.02.2011 and Circular No. 208 dated 27.07.1998.
 
2). GOI, MoD letter No. 1(10)/2009-D(Pen/Policy) dated 29th August’ 2017.
 
Copy of GOI, MoD letter No. 1(10)/2009-D(Pen/Policy) dated 29th August, 2017 on the above subject, which is self-explanatory, is forwarded herewith as annexure to this circular for further necessary action at your end.
 
2. In terms of Para-1 of GOI, MOD letter dated 29th August’ 2017, the fixed medical allowance has been enhanced from ₹ 500 / - pm to ₹ 1000 /- pm with effect from 01.07.2017. Ex-Servicemen who retired after 01.04.2003 have to become member of ECHS compulsorily and are not eligible to draw Fixed Medical Allowance. However, Pre-01.04.2003 retirees have the option of either joining the Scheme or draw Fixed Medical Allowance as per the extant rates.
 
3. The other conditions for grant of Fixed Medical Allowance as brought out in this Office Circular No. 208 dated 27.07.1998 quoted under reference shall continue to be in force. PDAs are requested to please review the cases and revise the Fixed Medical Allowance in all the affected cases accordingly.
 
4. This circular has been uploaded on this office website www.pcdapension.nic.in for dissemination to all alongwith Defence pensioners and Pension Disbursing Agencies.

Maximum age of joining National Pension System (NPS) increased from the existing 60 years to 65 years under NPS- Private Sector.

In continuance of the several initiatives under taken by Pension Fund Regulatory and Development Authority (PFRDA) during the last few years to increase the pension coverage in the country, PFRDA has now increased the maximum age of joining under NPS-Private Sector (i.e. All Citizen and Corporate Model) from the existing 60 years to 65 years of age.

The All-India CPI-IW for September, 2017 remained stationary at 285 (two hundred and eighty five). On 1-month percentage change, it remained static between August, 2017 and September, 2017 when compared with the decrease of (-) 0.36 per cent for the corresponding months of last year.
